Georgia DUI Field Sobriety Tests (FST’s)

If you have been arrested for DUI in Georgia, you were probably asked to perform field sobriety tests also known as FST’s. These so called tests are supposed to help the officer decide if someone is at or over the legal limit. However, if these tests are not performed properly, the results are questionable.

The three standardized evaluations are:

  1. One leg stand
  2. 9 step walk and turn
  3. Horizontal Gaze Nystagmus (HGN)

It is important to know that these tests are 100% voluntary. Just as you have the right to remain silent and not make any statements regarding the consumption of alcohol, you are not required to perform these evaluations. A fourth test, the hand held portable breath test is also 100% voluntary.

Even if performed properly, FST’s are not 100% accurate. For example a properly administered HGN test is reliable 77% of the time. That means that 23 out of 100 subjects who allegedly fail this test may not be over the legal limit.
